Immigration Battle Heard In Federal Appeals Court

A federal appeals court is hearing arguments this morning in a challenge by Attorney General Ashley Moody to immigration-enforcement moves by the Biden administration. Miami Immigration Attorney Tammy Fox-Isicoff says Moody's argument that the administration is not properly carrying out immigration laws and is threatening public safety is flat-out wrong. Moody is appealing a judge's ruling turning down the state's request for a preliminary injunction. She says federal memos about enforcement violate the Administrative Procedure Act, but the lower court says the memos are not final actions so they're not subject to judicial review.
